Legislative
Accomplishments…
Over the past few years the Missouri Recreational Vehicle Dealers
Association (MRVDA) has been consistently successful in representing
the Missouri RV dealers across Missouri in the state legislature.
- Seals: The Public Service
Commission in the past required an onerous system of PSC seals,
MRVDA deleted the seal system in 1998.
- Out -of -State Show Promoters: Show
promoters from out-of-state had previously held shows in
Missouri excluding Missouri based RV dealers. MRVDA successfully
passed legislation prohibiting out of state show promoters from
coming into Missouri unless Missouri RV dealers were a major
part of the show. Senate Bill 82 Section 301.566 RSMo. MRVDA has
also defeated attempts by out–of- state show promoters to
overturn the legislation last session.
- Dealer/ Manufacturer Agreements:
MRVDA was involved in the incredibly detailed negotiations of
the statute for Missouri’s Dealer/ Manufacturer Agreements.
These statutes can be found in RSMo sections: 407.1320 through
407.1346. The statutes cover numerous topics including
merchandising, warranty service, dealer agreements, termination
and change in ownership. These are statutes that will affect
your daily operations.
- Dealer Tags- MRVDA successfully
amended an initiative by the Missouri Department of Revenue that
would have limited dealers to one tag per 10 units. This would
have been very restrictive in transportation to shows. RV
dealers are now allowed 3 tags per 10 units.
- Liens- Numerous meetings with the
Department of Revenue addressed the problem of having original
titles available at the time of sale of consignment vehicles.
The Missouri Department of Motor Vehicles has agreed to allow
copies of the front and back of titles to be utilized for sales
until liens have been released.
- Defeated: MRVDA has defeated an
amendment that would have allowed customers to seek legal action
against RV dealers taking a car or RV in as trade from selling
the vehicle in an “as is” condition. Senate Bill 313 (2007)
- Returns: MRVDA deleted language
allowing customers to return an RV after a day period without
penalty. In the past RV dealers have had vehicles “trashed” and
had to absorb the loss. Senate Bill 82 (2007)
- Bonding: MRVDA defeated a provision
requiring current bond requirements to be raised from $25,000.00
to $100,000.
- Legal Protection: MRVDA supported
House Bill 1970 (2008) fought by trial attorneys. This
legislation will prohibit legal action against RV dealers by
persons whom the RV dealer did not personally negotiate during
the retail sale of a vehicle. Nothing in the statute prohibits
legal action against a seller if that person directly negotiated
with the person.
As you can see Missouri RV dealers need
representation in our capitol. MRVDA is there for you and your
interests. 
Issues this year will include a Missouri
Department of Transportation effort to collect sales tax at the
point of sale. MRVDA will be promoting a means to have Missouri RV
dealers cover costs and make a profit if this system is instituted.
